OEM vs. Aftermarket Parts: Shop Disclosure Checklist

A practical workflow for documenting OEM, aftermarket, remanufactured, recycled, and customer-supplied parts from estimate through invoice.

The estimate says, “Front lower control arm — OEM equivalent.” The supplier sends a different brand from the one the service advisor discussed. Its catalog says the part fits, so the technician installs it. The final invoice repeats the generic estimate line.

Later, the customer sees the box in the trash and asks a simple question: “Is this the part I approved?”

The shop cannot answer that question from the repair file.

This is not primarily an argument about whether original-equipment or aftermarket parts are better. It is a document-control failure. The estimate did not define the offered product, the authorization did not preserve the customer's selection, receiving did not record the product that arrived, the work order did not stop an unapproved substitution, and the invoice did not identify what was installed.

Right-to-repair laws and policies, warranty law, parts terminology, safety and emissions rules, state estimate requirements, insurer allowances, supplier availability, and customer preference can all shape a parts decision. None, by itself, settles the others.

A reliable repair authorization should connect six facts:

  1. the vehicle and repair condition evaluated;
  2. the part option the shop actually offered;
  3. the material differences disclosed to the customer;
  4. the option the customer authorized;
  5. the exact product the shop received and installed; and
  6. the price, warranty, and post-repair information on the invoice.

This article provides an operational framework for documenting that chain. It is not legal advice, a universal parts-classification standard, or a judgment that one parts channel is always preferable.

The short version: right to repair may give an owner or independent shop access to information, tools, or data needed for a repair. It does not approve a particular replacement part. Quote a specific option, stop when the supplied product differs, obtain a revised authorization when required, and reconcile the installed part with the final invoice and warranty record.

Documentorium can hold each decision in its existing forms. Use the automotive inspection report for the condition, test evidence, and recommendation. In the automotive quote, use “Parts (detailed)” to record each option's manufacturer or brand, part number, part type, unit price, availability, lead time, core charge, and warranty. Put a stable option ID in the description and use the notes for condition, included hardware, and programming or calibration assumptions.

Copy the selected option into the repair authorization with the exact dollar limit. In the repair order, carry the option ID into the item number or description, repeat the part number or SKU, and put any receiving or substitution hold in the notes. Separate four decisions that are often confused

The phrase right to repair is sometimes used as if it resolves every parts dispute. It does not.

Treat these as four distinct decisions:

Massachusetts' motor-vehicle right-to-repair law is a useful example of the first category. It addresses owner and independent-repair-facility access to diagnostic and repair information and tools that manufacturers make available to dealers, with detailed provisions for vehicle-generated data. It does not automatically select a brand of replacement part for a particular job. EPA's current Freedom to Fix guidance similarly describes access to emissions-related service information, OBD data, reprogramming information, and tools; that access does not certify or authorize a particular replacement product. These rules are jurisdiction- and system-specific, and the national landscape changes, so a shop should verify the law governing its location and the vehicle rather than copy one jurisdiction's language into every repair order.

The FTC's Nixing the Fix report likewise discusses access to replacement parts, instructions, and diagnostic software as a repair-restrictions issue. Access to those resources is not a product approval or a substitute for vehicle-specific fitment and procedure checks.

Do not tell a customer that right-to-repair rules mean:

  • a shop must accept every customer-supplied part;
  • every aftermarket part is suitable for every application;
  • a manufacturer must pay for damage caused by an unrelated part or installation;
  • safety, emissions, theft-prevention, privacy, intellectual-property, or cybersecurity controls disappear;
  • an insurer's parts allowance becomes the customer's authorization;
  • an information-access entitlement is a certification of a particular replacement part; or
  • a shop may ignore the repair procedures, calibration steps, or legal requirements that govern the completed vehicle.

Use access rights to obtain what is lawfully available. Then make and document the repair-method and parts decisions on their own evidence.

Define the parts vocabulary on every estimate

Parts labels are not consistently used across manufacturers, suppliers, insurers, repairers, and state laws. OEM, OE, genuine, OEM supplier, OE equivalent, and like kind and quality can mean different things to different readers.

A shop should write down a plain-language glossary, align it with applicable law, and use the same categories in its estimate, authorization, work order, receiving record, and invoice. A workable internal taxonomy might include:

Automaker-branded new part

A new part sold under the vehicle manufacturer's authorized parts brand—often marketed as “genuine”—and identified by that brand's part number. Record the exact brand and part number. Do not reduce this to OEM if state law or the customer's question requires a more precise description.

New part sold under an OE supplier's brand

A new part sold under the component manufacturer's own brand rather than the automaker's brand. The supplier may also manufacture parts for original vehicle production, but that fact alone does not prove the retail part has the same specification, materials, quality controls, software, included hardware, warranty, or production source as the automaker-branded part.

Avoid the unsupported statement same exact part without the logo. Make that claim only when the specific manufacturer supplies reliable evidence for the specific part number and application.

New aftermarket part

A new replacement part sold outside the automaker-branded channel. Identify the manufacturer or brand, part number, application, product line or grade where relevant, and any claimed certification or standard. Aftermarket describes a channel or category; it is not a single level of quality.

Remanufactured part

A used core restored through a defined manufacturing process and sold for reuse, often with replaced wear items, testing, and a product warranty. Record the remanufacturer, part number, core terms, and warranty. Do not assume that remanufactured, rebuilt, and reconditioned are legally interchangeable in the governing state.

Rebuilt or reconditioned part

A previously used unit repaired or restored to a stated condition. Document who performed the work, what scope or test standard applies, and what warranty is offered. Use the exact disclosure term required by applicable law.

Recycled or used part

A previously installed part removed from another vehicle or assembly and offered for reuse. Record the source facility, donor identification that may lawfully be retained, mileage if represented and supported, grade or condition, inspection, damage, compatibility, and warranty. Never describe unknown donor mileage as confirmed.

Customer-supplied part

A part sourced by the customer and tendered to the shop for possible installation. Record its actual brand, part number, represented condition, source evidence, packaging, and observed condition. Customer supplied does not establish fitment, legality, authenticity, safety, or serviceability.

Core or exchange unit

A replacement supplied on the condition that the old unit is returned or a core charge is paid. Disclose the core amount, ownership and return terms, inspection criteria, timing, and what happens if the core is not eligible.

Unknown, unverified, or suspected counterfeit product

Do not force an uncertain product into a reassuring category. Quarantine it and resolve the source, markings, and application before installation. If authenticity or compliance cannot be established to the level the job requires, decline it.

The goal is not to create a universal dictionary. It is to prevent a customer from approving one meaning while the shop installs another.

Start with exact vehicle configuration, not a generic application

A parts decision is only as good as the vehicle identification behind it.

On the inspection report and estimate, capture as applicable:

  • full VIN in the controlled shop record;
  • year, make, model, body, trim, and drive configuration;
  • engine, transmission, axle, brake, suspension, emissions, battery, charging, or other relevant configuration;
  • production date and plant where the application depends on a breakpoint;
  • automaker option codes, build data, or equipment labels;
  • current mileage and operating-hours data where relevant;
  • state registration or plate only as a secondary lookup aid;
  • modifications, conversions, upfits, prior collision repairs, salvage history, or nonstandard equipment observed or reported;
  • current calibration, software, module, or part number when the procedure requires it;
  • open recall status when checked through an authoritative source; and
  • the source and time of each lookup.

Do not expose the full VIN, home address, security code, key data, or unrelated customer information on public photos or supplier messages that do not need it. Give each vehicle and repair event a stable shop identifier.

An application result such as fits 2018–2022 is not enough when production breaks, brake packages, sensor connectors, regional emissions families, payload classes, adaptive lighting, advanced driver-assistance systems, or software versions differ.

Give the customer a comparison they can actually evaluate

The estimate should identify each offered option before the customer chooses. A practical comparison record includes:

If the brand or exact part number is not known when the initial estimate is prepared, say so clearly and require a second approval checkpoint before ordering or installation. Do not fill the gap with OEM equivalent.

A useful provisional line is:

Option P-02B: new aftermarket right-front wheel bearing/hub assembly. Manufacturer and exact part number are not yet assigned because supplier stock is changing. Maximum authorized parts price: $____. Shop must send the manufacturer, part number, warranty, and any material scope change for customer approval before ordering or installation. No automatic substitution is authorized.

Fill every blank with the facts of the actual transaction before the customer authorizes it.

Explain warranty law without promising too much

The federal Magnuson-Moss Warranty Act and the Federal Trade Commission's anti-tying rule matter when a consumer warranty is conditioned on use of a named article or service. The FTC explains that a warrantor generally cannot require branded parts or service as a warranty condition unless the item or service is provided without charge or the FTC grants a waiver.

That principle does not mean every failure after an aftermarket repair must be covered. The FTC's consumer guidance on auto warranties also explains that warranty coverage may be denied for damage caused by an aftermarket or recycled part or improper installation. The distinction is between voiding coverage merely because an independent part or service was used and excluding a failure actually caused by that part or service.

Before advising a customer, identify which promise is involved:

  • vehicle manufacturer's written warranty;
  • federal emissions warranty;
  • state emissions warranty;
  • recall or service campaign;
  • dealer or seller warranty;
  • service contract, which is not necessarily the same as a warranty;
  • parts manufacturer's warranty;
  • distributor warranty;
  • shop workmanship warranty; or
  • insurer or fleet repair program.

Read the current terms and identify the decision maker. Do not write will not affect your warranty or voids factory warranty as a blanket statement.

A more accurate disclosure is:

The customer asked about remaining vehicle warranty coverage. The shop has not decided whether a manufacturer, service-contract, emissions-warranty, or insurer claim is covered. Federal law generally limits warranty tying to branded parts or service, but coverage may depend on the cause of a later failure and the applicable written terms. The customer should review the current warranty or contract and obtain the warrantor's decision when coverage is material.

If a potentially covered condition is found, document that the customer was told before paid work removes the warrantor's opportunity to inspect or perform the repair.

Treat state estimate and invoice rules as a separate layer

Repair-document rules vary by state and sometimes by repair type. Verify the current rules for the shop, customer, vehicle, and transaction.

California's Bureau of Automotive Repair provides a concrete example in its current Write It Right guide:

  • each part on a standard estimate is treated as new unless it is identified as used, rebuilt, or reconditioned;
  • each new replacement crash part is treated as new OEM unless the collision estimate identifies it as non-OEM aftermarket or used;
  • labels such as Opt-OEM, Alt-OEM, OEM-Surplus, Like Kind Quality, and Quality Replacement Part do not satisfy that crash-part disclosure; and
  • windshield estimates have a separate OEM/non-OEM disclosure.

The same guide requires customer authorization before repair, additional authorization before a change in the repair method or parts supplied, and invoice descriptions that identify parts in plain terms and use the required condition and crash-part disclosures.

Those are California examples, not national boilerplate. They illustrate three useful controls for every shop:

  1. use the classification words required by the governing state;
  2. obtain approval before changing the method, part category, or charge; and
  3. make the final invoice describe what was actually installed.

Do not assume an electronic approval platform cures an incomplete estimate. An electronic signature can record assent to what the customer was shown; it does not supply a missing brand, part category, price, or material term. Under the federal E-SIGN Act, electronic records and signatures generally cannot be denied legal effect solely because they are electronic, but consumer disclosures, consent, retention, state law, and transaction-specific exceptions still matter.

Put a substitution gate between purchasing and installation

Availability changes. The approved part may be back-ordered, superseded, damaged, mislabeled, or unavailable at the quoted price. A supplier may send what its catalog calls an alternative.

That is a reason to stop, not a reason to rewrite history.

Define material substitutions in the shop policy. They should include at least a change in:

  • manufacturer or brand;
  • part number or product line;
  • new, remanufactured, rebuilt, reconditioned, recycled, or used condition;
  • parts channel or category—for example, automaker-branded, an OE supplier's own brand, or aftermarket;
  • design, material, country or facility where that fact was expressly material to the customer;
  • fitment or production-break basis;
  • required certification, label, marking, or application approval;
  • included hardware, sensor, module, software, programming, calibration, or refinishing;
  • warranty provider, duration, labor coverage, or claim process;
  • price, freight, core, or return terms;
  • delivery date where timing is material; or
  • repair procedure or expected result.

For a material change:

  1. stop ordering or installation at the defined gate;
  2. create a revised option with a new version or change ID;
  3. explain the change without disparaging unsupported alternatives;
  4. state the new total, warranty, timing, and procedural effects;
  5. obtain authorization through a legally permitted method;
  6. attach the authorization event to the revised record; and
  7. update the technician's work order.

Never alter the original signed estimate to make the received part appear preapproved. Preserve the original, revision, timestamps, sender and recipient, authorization method, and exact approved version.

Inspect and identify the part at receiving

The purchasing record shows what was ordered. It does not prove what arrived.

At receiving, compare the shipment with the approved option and record:

  • purchase-order and supplier identifiers;
  • manufacturer or brand on the product and packaging;
  • part number, suffix, supersession, quantity, and handedness;
  • serial, lot, date, calibration, software, or batch identifier where relevant;
  • new, remanufactured, rebuilt, reconditioned, or used condition;
  • tamper seals, holograms, labels, certification marks, or application identifiers relevant to the product;
  • packaging condition, shipping damage, corrosion, contamination, prior installation marks, or missing items;
  • connector, mounting, dimensions, sensor, bracket, material, finish, and included hardware;
  • instructions, warranty card, core documents, and return restrictions;
  • the identity of the person who checked it; and
  • photos proportionate to the risk and warranty needs.

Do not treat a scan of the distributor barcode as proof of the manufacturer's identity. Photograph or transcribe the product markings needed to distinguish the actual item, without disclosing unrelated customer or security data.

Quarantine a mismatch. The technician should not have to decide silently that it is close enough once the vehicle is disassembled.

Tighten the gate for safety, emissions, security, and calibrated systems

Some parts decisions require more than commercial fitment.

Safety systems and regulated equipment

For a vehicle already sold to its first retail purchaser, NHTSA explains that 49 U.S.C. § 30122 does not prohibit the use of aftermarket parts in a repair per se. A repair business may not, however, knowingly make inoperative a device or element of design installed to comply with a federal motor vehicle safety standard. NHTSA also notes that some new replacement equipment—such as lamps and reflectors, tires, glazing, brake hoses, and seat-belt assemblies—is itself subject to federal standards and certification requirements.

NHTSA has separately warned about dangerous substandard replacement airbag inflators associated with deaths and serious injuries. For airbags, restraints, steering components, braking, glazing, lighting, tires, and other safety-critical systems, verify current automaker procedures, product source, applicable markings or certification, handling restrictions, and post-repair checks. Do not install a suspicious or unidentified product merely because its connector or mounting points fit.

Emissions-related parts

The Clean Air Act prohibits tampering with or defeating vehicle emissions controls. EPA's current tampering policy explains that aftermarket products cannot bypass, defeat, or render those controls inoperative. EPA has also recognized SEMA's Certified Emissions program as an alternative path for demonstrating federal compliance, but that recognition does not certify every aftermarket emissions product or make a certified product suitable for every application.

Catalytic converters show why a catalog match alone is insufficient. Federal anti-tampering rules apply; in California, CARB says an aftermarket converter must have an exemption Executive Order and be approved for the specific vehicle application. Verify the current federal and state rules before quoting, ordering, or installing a converter. Record the diagnosis, vehicle application, converter identification, required statements, warranty, installation, and retention evidence required for that transaction.

Never quote a tune, simulator, delete device, spacer, pipe, or software function as off-road or customer requested to bypass a rule that applies to the actual vehicle and use.

ADAS, modules, keys, and high-voltage systems

A bumper cover, windshield, mirror, lamp, steering component, ride-height component, wheel alignment, camera, radar, ultrasonic sensor, module, or bracket may affect an advanced driver-assistance system. The replacement choice may change programming, aiming, static or dynamic calibration, targets, road conditions, documentation, or sublet work.

Similarly, immobilizer, key, telematics, cybersecurity, and module work may require lawful credentialed access; high-voltage battery and EV components may require isolation, shipping, storage, software, and warranty controls.

The estimate should disclose those dependent operations rather than price the visible part alone. Record what procedure source and vehicle configuration were used, what work was performed, the results and limitations, and who performed any sublet work.

Use a written policy for customer-supplied parts

A customer may bring a less expensive part, a rare used component, a performance product, or an unopened item purchased for the wrong application. The shop needs a consistent policy before the vehicle is on the lift.

The policy should state:

  • whether the shop considers customer-supplied parts at all;
  • which safety, emissions, security, programmed, refrigerant, high-voltage, pressurized, or regulated categories it will not accept;
  • what source, receipt, markings, application, instructions, and condition evidence must accompany the part;
  • that inspection is limited and does not authenticate hidden materials or internal condition;
  • that the shop may decline or stop if fitment, legality, safety, completeness, or procedure support is not established;
  • who bears diagnostic, teardown, reassembly, freight, delay, storage, repeat-labor, programming, calibration, and disposal charges;
  • how the parts warranty and shop workmanship warranty differ;
  • who handles the seller's return or warranty claim;
  • what happens if the part fails during installation or testing;
  • whether removed parts or cores can be released and under what legal and supplier constraints; and
  • that no waiver authorizes unsafe, unlawful, or technically unsupported work.

Avoid an overbroad shop has no responsibility for anything clause. The shop remains responsible for its own authorized work under applicable law. Define the boundary precisely:

Customer supplied part CSP-01, represented as new, brand ___, part number ___, receipt/source ___, packaging condition ___. Shop's pre-installation check is limited to visible condition, markings, listed application, and accessible dimensional or connector comparison. It does not verify hidden materials, manufacturing quality, internal condition, authenticity, or future durability. Installation remains subject to current procedure, legal, safety, emissions, programming, and fitment checks. If the part fails those checks, work stops and the customer will be contacted before additional labor or an alternative part.

Keep insurer estimates separate from customer authorization

In collision work, an insurer may write or approve an allowance using particular part categories, labor operations, rates, or procedures. That record is evidence of the insurer's position. It is not automatically:

  • the repairer's complete damage assessment;
  • the repair plan required by current procedures;
  • proof that the listed part is available or suitable;
  • customer authorization to repair;
  • a waiver of the shop's legal or safety obligations; or
  • the final invoice.

Reconcile the insurer estimate, shop estimate, customer selection, repair procedure, parts invoice, and final bill. When hidden damage, a material part substitution, required calibration, one-time-use component, or procedure change appears, document a supplement and obtain customer authorization as state law and the repair agreement require.

For crash parts, use the exact OEM/non-OEM/used terminology and separate disclosure required in the governing state. Do not conceal a category behind a supplier code or insurer abbreviation the customer cannot reasonably understand.

Write technician instructions that preserve the authorization

The customer-facing estimate and the technician-facing work order should refer to the same stable option and part identifiers.

For each part, the work order should show:

  • repair line and operation ID;
  • approved option ID and estimate revision;
  • part description and vehicle location;
  • approved manufacturer or brand and part number;
  • condition and source category;
  • quantity and matched pairs or sets;
  • one-time-use hardware and consumables;
  • service-information source and procedure identifier;
  • torque, sequence, fluid, sealant, cleanliness, or handling controls where appropriate;
  • programming, initialization, relearn, aiming, alignment, or calibration dependency;
  • pre- and post-scan requirements and diagnostic boundaries;
  • hold points for comparison, photos, supervisor review, or customer contact;
  • removed-part and core instructions; and
  • final verification and sign-off fields.

Include a clear stop rule:

Do not install a different brand, part number, condition, category, or materially different included component. Place the item on hold, record the mismatch, and return the job to the service advisor for technical review and revised customer authorization.

The rule keeps the technician from being forced to make a customer-authorization decision at the bay.

Match the approved, received, installed, and invoiced records

Use a parts reconciliation table before closing the repair:

The final invoice should identify, as applicable:

  • plain-language part description and vehicle location;
  • manufacturer or brand;
  • part number and quantity;
  • condition and OEM/non-OEM category using required legal terminology;
  • serial, lot, or core identifier where needed for traceability or warranty;
  • parts price and other required charges;
  • labor operations;
  • programming, calibration, sublet, supplies, freight, core, and tax;
  • approved revisions and their authorization references;
  • replaced-part return or core disposition;
  • parts and workmanship warranties, with the correct warrantor;
  • post-repair tests and outcomes;
  • unresolved recommendations or declined work stated factually; and
  • vehicle-out mileage and completion acknowledgment.

Do not put the quoted brand on the invoice if a different approved brand was installed. Do not put new when the installed unit was remanufactured. Do not hide a customer-supplied part behind the shop's normal parts line.

Document removed parts, cores, and warranty returns

The old component can be customer property, supplier core, warranty evidence, hazardous material, regulated waste, or evidence relevant to a dispute. The correct treatment depends on state law, the repair agreement, supplier terms, and the part.

Before work, record:

  • whether the customer requests return of replaced parts;
  • which parts cannot be returned because of exchange/core, warranty, hazardous-material, safety, or legal restrictions;
  • whether the customer can inspect the part before disposition;
  • core charge and return deadline;
  • required labels or chain-of-custody record;
  • storage period and disposal method; and
  • who owns any supplier credit.

At closeout, record the actual disposition. Do not promise to return a core and then send it to the supplier without documented customer agreement and legally sufficient disclosure.

Tie the warranty record to the installed product

At closeout, make sure the invoice repeats the authorized and installed option, actual brand and part number, labor, programming or calibration, core or removed-part disposition, and warranty source. Use the completion sign-off only for the handoff and noted exceptions—not as a waiver of an undisclosed substitution. A parts warranty cannot be administered reliably if the file records only alternator.

Retain:

  • installed manufacturer or brand and part number;
  • serial, batch, or date code where relevant;
  • purchase source, invoice, and purchase date;
  • vehicle and mileage at installation, plus the repair-order ID;
  • product registration or warranty card;
  • warrantor and claim channel;
  • parts term and labor coverage;
  • exclusions, maintenance duties, transferability, and geographic limitations;
  • diagnostic findings if a claim later arises;
  • removed warranty-part disposition and supplier authorization; and
  • shop workmanship-warranty terms.

If a supplier offers lifetime warranty, state whose lifetime, which purchaser, what is replaced, whether labor is included, and what proof is required. Marketing shorthand should not replace the written terms.

A synthetic example from estimate to invoice

Assume a customer presents a vehicle with front-end noise. The shop confirms play at the right-front lower ball joint, which is serviced only with the control arm under the current parts catalog and service procedure.

Estimate

The shop offers:

  • P-01A: automaker-branded new control-arm assembly, brand and part number identified, new one-time-use fasteners included, parts-and-labor warranty stated, available next business day;
  • P-01B: named aftermarket premium-line new assembly, exact part number identified, fasteners included, separate manufacturer parts warranty and shop labor warranty stated, in local stock; and
  • P-01C: named economy-line new assembly, exact part number identified, fasteners excluded, shorter parts warranty, in local stock.

The estimate separately includes alignment and states that steering-angle or ADAS-related procedures will be checked against the vehicle's current configuration and service information before work begins. If a scan, calibration, or other operation is required, the shop will revise the estimate and authorization before performing it.

Authorization

The customer selects P-01B and electronically authorizes estimate revision 2, total not to exceed the displayed amount without further approval. The record preserves the content displayed, delivery result, timestamp, and customer action.

Receiving

The box received for P-01B contains a different product line from the same manufacturer and a different part number. Receiving marks it HOLD — does not match P-01B and photographs the label.

Revision

The supplier confirms that P-01B is unavailable. The shop sends a new option with the actual part number, differences in product line, warranty, price, and delivery time. The customer declines it and selects P-01A. The shop preserves both decisions.

Installation and closeout

The technician confirms P-01A markings, follows the identified procedure, replaces the listed one-time-use hardware, records torque completion, completes the alignment, and records the applicable post-repair checks. The invoice lists the automaker brand, part number, new condition, related hardware, alignment, warranty, and approval revision.

No one has to reconstruct the decision from memory. The file shows why the installed item differs from the first option discussed and proves that the difference was approved before installation.

A compact quality-control checklist

Before releasing the vehicle, confirm:

  • [ ] vehicle configuration and repair line are correctly identified;
  • [ ] each offered option uses a defined parts category;
  • [ ] manufacturer or brand, part number, condition, and warranty are stated or explicitly held for later confirmation;
  • [ ] regulated or safety-critical application evidence is present;
  • [ ] the customer selected a specific option and authorized the correct estimate version;
  • [ ] any material substitution has its own revised approval;
  • [ ] the received product matches the approved product;
  • [ ] the technician work order matches the approved revision;
  • [ ] required programming, calibration, alignment, scans, tests, and sublet work are recorded;
  • [ ] removed-part and core disposition is complete;
  • [ ] the invoice matches the item actually installed;
  • [ ] warranty evidence is attached to the actual product.

Common questions

Does right to repair require a shop to install any part the customer brings?
No. Information or tool access and acceptance of a particular product are separate questions. A shop may apply a lawful, consistently administered customer-supplied-parts policy and should decline work it cannot perform safely, legally, or with reliable service information.
Does using an aftermarket part automatically void the vehicle's entire warranty?
Generally, no. The FTC's auto-warranty guidance says that using an aftermarket or recycled part does not by itself void the warranty. A warrantor generally cannot condition coverage on a named part or service unless it is free or a waiver applies. It may, however, deny coverage for damage it can show was caused by an aftermarket part or improper installation. The particular written warranty, emissions warranty, service contract, and state law still need review.
Is a part sold under an OE supplier's brand always identical to the automaker-branded part?
No. A company may supply original production parts and also sell a retail product, but that fact alone does not prove identical specifications, materials, quality controls, software, included items, source, or warranty for a particular part number. Describe the actual product and retain product-specific evidence.
Can an estimate simply say OEM equivalent?
That phrase is too ambiguous for a customer to know what product is offered, and it may fail state-specific disclosure rules. For a useful authorization, identify the actual category, manufacturer or brand, part number, condition, warranty, fitment basis, included work, and price—or state what remains unresolved and require approval before ordering or installation.
Can the shop substitute a different brand at the same price?
Only if the governing law and the customer's authorization actually permit that substitution. The safer operational rule is to treat a brand, part-number, category, material warranty, or procedural change as a hold point and obtain revised approval before installation.
Does an insurer's estimate authorize the repair?
Not by itself. It records the insurer's allowance or position. Customer authorization, the repairer's complete plan, current procedures, legal disclosures, supplements, and the final invoice remain separate records.
What should the shop do when the supplier sends a superseded part number?
Verify the supersession through an authoritative current source, confirm application and procedural effects, and compare category, included items, warranty, price, programming, and calibration. If the change is material or outside the existing authorization, document it and obtain revised approval before installation.
Can a customer waive safety or emissions requirements?
No. A customer may decline a repair, but customer consent does not authorize a repair business to make required safety equipment inoperative, install noncompliant regulated equipment, tamper with emissions controls, or perform otherwise unlawful work. NHTSA's aftermarket-parts interpretation and EPA's tampering policy explain the relevant federal limits; state rules may add more.
Should the invoice list the brand and part number?
Include them whenever governing law requires them and whenever they are needed to prove that the installed item matched the authorization, administer a warranty, or distinguish the part. At minimum, use the plain-language description and condition/category disclosures required by the governing state.
Who owns the removed part?
It depends on state law, the repair agreement, customer request, core or exchange terms, warranty requirements, and hazardous or regulated handling rules. Disclose the rule before repair and record the actual disposition at closeout.
How long should parts and authorization records be kept?
Follow the longest applicable state repair-record rule, tax and accounting requirement, warranty or service-contract term, insurer or fleet obligation, litigation-hold instruction, and documented business need. Use a written retention schedule and protect or destroy personal and security-sensitive information appropriately.
